Purchase Contract Disclosure Notices

The purchase contract also includes disclosures made by the seller. What the seller is required to disclose varies from state to state, but will include those facts which may not be apparent, but which may affect the sale. Which of these items might need to be disclosed by the seller?

  1. How close the house is to the nearest elementary school

  2. If there's been a problem with termites on the property

  3. Whether public transportation is available in the area

The correct answer is "B". Public information is readily available on where schools and public transportation are located. The seller is more likely to know things like whether the property had termites or leaks in the roof, or if there's a border dispute. These facts may affect your purchase decision, so they may need to be disclosed.
